Terms and Conditions of Use

1. Introduction and provider details
The site nativer.it (the "Site") is operated by Nativer – Milan (MI), Italy — email rocks76@gmail.com ("Nativer" or "Provider"). Using the Site implies full acceptance of these Terms.
2. Nature of the service
Nativer is a contact marketplace: it connects family users with users offering childcare or domestic help services (nannies, domestic helpers). Nativer is not a staffing agency (Italian Legislative Decree 276/2003): it does not select, hire, guarantee or answer for the conduct of users on the platform. The employment, financial, tax and contractual relationship remains exclusively between the parties.
2-bis. Verification of information
The information shown in profiles is provided directly by users. Nativer does not verify its truthfulness, freshness or completeness.
2-ter. Responsibility for checks
Families are responsible for the checks, interviews and assessments carried out before starting any relationship with other users.
3. Registration and account
Registration is reserved to adults. The user warrants the accuracy of the data provided and is responsible for their login credentials. Nativer may suspend or close accounts in case of breach of these Terms.
4. Contact Pass — consideration
The Contact Pass is a paid digital service, one-off, that allows the family user to see the contact details of the available profiles for the stated duration (30 / 90 / 365 days). No automatic renewal. Prices include VAT as stated on the dedicated page.
5. Right of withdrawal and digital content (arts. 52-59 Italian Consumer Code)
Under art. 59, letter o) of Italian Legislative Decree 206/2005, the consumer loses the right of withdrawal for the supply of digital content not delivered on a tangible medium if performance has begun with the consumer's express consent and their acknowledgement that they would lose the right of withdrawal. By confirming the purchase of the Contact Pass, the user expressly requests immediate activation and accepts the loss of the right of withdrawal.
In case of a technical malfunction attributable to Nativer that prevents you from using the Pass, write to rocks76@gmail.com for a pro-rata refund.
6. User obligations
The user undertakes not to publish false, offensive, discriminatory or unlawful content; not to use contact details for spam or for purposes other than professional contact; and to comply with the applicable rules on domestic work (Italian CCNL Lavoro Domestico, INPS-COLF contributions, etc.).
7. Limitation of liability
Within the limits allowed by law, Nativer is not liable for damages arising from the relationship between users, from inaccurate information entered by users, or from service interruptions due to causes beyond its control. The mandatory rights of the consumer remain unaffected.
7-bis. Indemnity
The user undertakes to hold Nativer harmless from claims, demands, damages or disputes arising from the relationships established between users through the platform.
8. Intellectual property
Trademarks, logo, layout and code of the Site are the property of the Owner. Unauthorised reproduction is prohibited. Content uploaded by users remains theirs; by publishing it they grant Nativer a non-exclusive, free and revocable licence to display it on the Site.
9. Privacy
The processing of personal data is described in the Privacy Notice and in the Cookie Policy.
10. Changes
Nativer may update these Terms; changes will be notified by email or via the Site with at least 15 days' notice for material changes.
11. Applicable law and jurisdiction
These Terms are governed by Italian law. For consumers, exclusive jurisdiction lies with the court of the place of residence or domicile (art. 66-bis Italian Consumer Code). For other users, exclusive jurisdiction lies with the court of Milan.
Consumers may also use the European Online Dispute Resolution platform (ODR): ec.europa.eu/consumers/odr.
